The Western approach to cybercrime within the negotiations has been to create an agreement of narrow scope, which includes only cyber-dependent crimes. Such crimes include those in which the computer system or the network is the object of attack, such as malware attacks, denial of service attacks or ransomware attacks. These crimes are covered within the Council of Europe Convention on Cybercrimes, along with a select number of cyber-enabled crimes which include online child exploitation and computer fraud, which western States advocate to be included within the new Treaty. It appears very much therefore that Western States are seeking to replicate the terms of the UN Treaty along the lines of the scope of the existing Council of Europe Convention on Cybercrime (‘Cybercrime Convention’)
