Pour de nombreuses règles relatives aux lieux de prestation, il est important de déterminer si la prestation est destinée à un vrai client professionnel (B2B) ou à un client non professionnel (B2C). La prestation est réputée B2B si le client est un vrai professionnel. Par vrai professionnel, on entend :
assujetti au sens de l'article 9 de la directive principale sur la TVA.
immatriculé à la TVA au Royaume-Uni.
immatriculé à la TVA dans un autre État membre.
immatriculé à la TVA à l'île de Man.

Cela pose un problème de traduire "relevant business persons" simplement par "personnes exerçant une des activités économiques concernées", comme on voudrait le faire par analogie avec la législation française

En effet, ce niveau-là semble défini pour "taxable persons" dans l'Article 9 "of the Principal VAT Directive", auquel on a rajouté les autres cas. Si on choisit cette traduction, on aurait donc deux fois "personnes exerçant une des activités économiques concernées", l'une étant la définition de l'autre.

Je pense donc qu'ici, on essaye à la base de définir si on a affaire à une opération entre un professionnel et un autre "vrai" professionnel, au lieu d'un client non-professionnel, "vrai" s'entendant dans le sens de conforme aux activités professionnelles d'un professionnel au regard de la TVA.

Je pense aussi qu'on a affaire à une notion juridique figée dans une cadre particulier, et je propose de la garder et de la mettre entre parenthèses.
