Used in referring to a sentencing proposal. Other examples from different sources:

"Nu rör det sig om flera brott (5 stölder). Huvudregeln är att även den som begått flera brott ska dömas till gemensam påföljd (30 kap 3§ BrB). Vid flera brott använder man sig av aspirationsprincipen (26 kap 2§ BrB) för att konstruera en straffskala för den samlade brottsligheten."

Asperation Asperation it is, well done Adrian. It’s still going to need explaining though. Asperation means to make harsher, yet really while they’re adding years they’re making the overall sentence more lenient.

I have now reflected on Adrian’s hunch about sweeping up all the offenses at the same time. The language of Chapter 26, Section 2 of brottsbalken puts a fairly severe limitation on stringing sentences together consecutively. Here in the U.S., bargaining over concurrent versus consecutive sentences is a regular aspect of criminal prosecutions. I haven’t had occasion to read sentencing decisions from the Supreme Court of Sweden, but I suspect they disfavor consecutive sentencing on principle as a consequence of the statute.

A discounted tariff in UK criminal law is generally available for a guilty plea cf. och sedan reduceras straffvärdet på resterande brott..

My hunch is that aspiration is referring to the 'consuming, sweeping or sucking up' of various sentences in one fell swoop.

A related issue: sentencing on a UK joined USA joint charge or indictment of a *nexus of linked offenc/ses.*

A combined sentence or combination order in the UK refers to combining different types of punishment.

I now have a horrible feeling - after checking my German law glossaries - that aspiration is a mis-spelling for 'asperation' > still a 'mopping-up of multiple offences' but from 'asperis' meaning made bitter or aggravated. There's a connected 'Asperation' doctrine in DEU / CH law of Tatmehrheit or Real- vs. Idealkonkurrenz and concurso real vs. ideal n SPA.
