Frage A. 1
Tragbare Feuerlöscher unterliegen nicht den Vorschriften des RID/ADR. Sie sind vielmehr
als Druckgeräte gemäß Richtlinie 97/23/EG zu betrachten, dürfen aber nach Sondervor-
schrift 594 RID/ADR (vergl. Leitlinie 24 zur TPED) transportiert werden.
Für Löschmittelbehälter für kleine, beim Hersteller betriebsfertig montierte Löschanlagen
könnte aus Sicht des Fragestellers eine Freistellung vom RID/ADR gemäß 1.1.3.1 „Freistel-
lung im Zusammenhang mit der Art der Beförderungsdurchführung", Buchstabe b ange-
wandt werden. Das BMVBS stellt jedoch in der als Anlage beigefügten Stellungnahme fest,
dass von einer Freistellung auf der Basis von SV 594 auszugehen ist.

Kleine Löschmittelbehälter (bis zu 20 kg Gesamtmasse) gelten ebenso wie Handfeuerlö-
scher als Feuerlöscher im Sinne der Sondervorschrift 594 des RID/ADR (verpackt und gesi-
chert gegen unbeabsichtigte Betätigung).
Zitat SV 594 (RID/ADR 2009):
„Folgende Gegenstände die nach den Vorschriften des Herstellerlandes hergestellt und
gefüllt und in einer starken Außenverpackung verpackt sind, unterliegen nicht den Vorschrif-
ten des RID/ADR:
- UN 1044 Feuerlöscher, wenn sie mit einem Schutz gegen unbeabsichtigte Betä-
tigung versehen sind;
- UN3164 ..."
Frage A.2
Weiterhin kennen wir fahrbare Löschgeräte, die als sogenannte Dauerdrucklöschgeräte
unter Druck stehen und auch unter Druck transportiert werden (müssen). Diese fallen nicht
unter die Freistellungsregelung der SV 594, die für tragbare Feuerlöscher gelten und wür-
den somit gemäß TPED Leitlinie 24 entsprechend den Vorschriften des RID/ADR zu be-
handeln sind. Der Normentwurf prEN 1866:2006 Teil 2, Annex A geht jedoch davon aus,
dass es sich bei diesen Geräten um Druckgeräte gem. Richtlinie 97/23/EG handelt (siehe
Anlage).
Ebenso wird für fahrbare CO2-Löschgeräte, bei denen das Löschmittel (Kohlendioxid) in
Stahlflaschen gespeichert ist, nach dem Normentwurf prEN 1866:2006 Teil 3, Abschnitt
6.2 und Annex A angegeben, dass es sich um Druckgeräte gem. Richtlinie 97/23/EG han-
delt.
Aus Sicht des Fragestellers ist in der Behandlung der Löschgeräte und Löschmittelbehälter
keine durchgehende Systematik zu erkennen, so dass der Fragesteller im Rahmen einer
Diskussion gerne die Meinung der Fachleute dazu hören würde.
Antwort A.2
Für Löschmittelbehälter/-flaschen mit mehr als 20 kg Gesamtmasse ist eine Zertifizierung
der Druckgefäße gemäß TPED erforderlich, wenn diese als Gefahrgut befördert werden
sollen. Eine TPED-Zertifizierung ist auch erforderlich, wenn es sich um gewöhnliche Druck-
gefäße handelt, die auch für allgemeine Zwecke der Beförderung von Gasen eingesetzt
werden können, z. B. CO2-Flaschen.
Sind Löschmittelbehälter ausschließlich für die Verwendung in mobilen oder stationären
Löscheinrichtungen vorgesehen und in diese fest eingebaut, so gilt die Freistellung gemäß
RID/ADR Absatz 1.1.3.1 b).
Frage A.3
Nachfrage zu Vorkommnissen/Problemen/Prüffristen für Paintball-Flaschen (Stichwort DOT)
Antwort A.3
Druckgefäße für Paintball-Anwendungen können im (speziell kommerziellen) Betrieb deut-
lich anderen Füll- und Entleerungshäufigkeiten und somit Lastwechselzahlen unterliegen,
als dies üblicherweise im Gefahrguttransport mit kaum mehr als 10-20 Füllungen im Jahr
der Fall ist. Dies muss besonders dann beachtet werden, wenn Normen aus dem Gefahr-
gutbereich für den Bau solcher speziellen Druckgefäße Verwendung finden, da deren An-
wendung nicht mit der Beförderung von Druckluft oder Stickstoff als Gefahrgut vergleichbar
ist. Auf jeden Fall sind dabei zusätzlich die Vorschriften des Arbeitsschutzes zu beachten.
Die Verantwortung außerhalb der Anwendung als Gefahrgut-Umschließung liegt beim An-
wender.
Gemäß RID/ADR Unterabschnitt 4.1.4.1 P200 Abs. (9) ist für die Prüffristenfestlegung von
Druckgefäßen aus Verbundwerkstoffen die zuständige Behörde des Landes zuständig, die
das technische Regelwerk für Auslegung und Bau anerkannt hat. Dies ist in D gemäß
RSEB 4-5.4 a) die BAM, da formal auch D die relevanten EN-Normen zum Zweck der Inbe-
zugnahme in RD/ADR anerkannt hat. Die BAM legt als Prüffrist für Druckgefäße für Paint-
ball-Anwendungen in Absprache mit dem BMVBS grundsätzlich 3 Jahre fest. Darüber hin-
aus enthält jeder Prüffristen-Bescheid folgenden Hinweis:
„Die Festlegungen der Prüffristen erfolgen nur unter Berücksichtigung der Anforderungen
für die Sicherheit der Beförderung gefährlicher Güter für die Beförderung von Composite-
Druckgefäßen im Straßen- und Eisenbahnverkehr. Sie gelten daher nur für den Zweck der
sicheren Beförderung.
Werden die Composite-Druckgefäße auch für andere Zwecke eingesetzt (z. B. vorüberge-
hende oder dauerhafte Verwendung in Anlagen mit abweichenden Betriebsparametern wie
Füllverfahren, Füllhäufigkeit etc.), sind ergänzende Regelungen anderer Rechtsvorschriften
(z.B. für den Umgang, die Lagerung, die Verwendung und Wiederbefüllung dort selbst) zu
beachten. Dies kann u. U. im Ergebnis zusätzliche Prüfungen, kürzere Prüfintervalle oder
anders kalkulierte Verwendungsdauern bedeuten. Vorschriften, die nicht die Beförderung
gefährlicher Güter behandeln, werden für die Bescheide zur Prüffristenfestlegung nicht ge-
prüft und bewertet."
Paintballflaschen, die nur eine US-amerikanische DOT-Zulassung aufweisen, dürfen inner-
halb der EU (Geltungsbereich der TPED) nicht in Verkehr/auf den Markt gebracht werden.
Die private Einfuhr, Verwendung und der private Gebrauch solcher DOT-Druckgefäße ist
nicht eindeutig geregelt, aber die Wiederbefüllung hat - sofern nicht im Einzelfall anders
geregelt - unter Voraussetzung der Kriterien nach z. B. den Kriterien TRG 402 (vergl. M 180
zu erfolgen. Für die Beförderung im privaten KFZ gilt die Freistellung gemäß RID/ADR Un-
terabschnitt 1.1.3.1 Abs. a), ähnlich wie für Taucherflaschen. Eine entsprechend geeignete
Verpackung und Ladungssicherung ist dabei Voraussetzung für diese Freistellung.

Im Zusammenhang mit dem Stichwort DOT-Zulassung wurde vom Publikum auf die gene-
relle Problematik im Umgang mit Druckgefäßen, die keine europäische oder nationale Zu-
lassung haben, und das Auslaufen der M180 hingewiesen. Siehe dazu auch Frage F.2.
Frage A.4
Der § 12 der GGVSEB fordert derzeit als Voraussetzung für die Prüftätigkeit nach 6.2.1.6.1
ADR die Qualifizierung als ZÜS nach GPSG und die benannte Stelle für ortbewegliche
Druckgeräte.
Im ADR 2009 Abs. 1.8.6.4 wird zukünftig die Prüfstelle, welche unter Beachtung der U-
Abschnitte 6.2.3.6 und der Sondervorschrift TA4 und TT9 des Abschnittes 6.8.4 nach EN
ISO/IEC 17020:2004 akkreditiert sein muss, als autorisiert benannt.
Wenn eine internationale Prüforganisation bereits nach EN ISO/IEC 17020 als Prüfstelle in
einem "ADR-Land" (Unterabschnitte 6.2.3.6 und der Sondervorschrift TA4 und TT9 des
Abschnittes 6.8.4 nach EN ISO/IEC 17020:2004) akkreditiert wurde, wird diese dann
auch als Prüfstelle im Sinne des ADR-Regelwerkes in Deutschland anerkannt?
Zur Klärung wurden hierzu folgende Fragen von der BAM an die Zentralstelle für Si-
cherheitstechnik der Länder (ZLS) gesandt:
1. Eine in einem anderen Mitgliedsstaat nach der kommenden TPED notifizierte Stelle hat
eine Niederlassung in D. Muss diese Niederlassung in D erneut notifiziert werden oder
hängt dies davon ab, ob sie eine eigenständige Firma ist?
2. Wenn diese Stelle eine eigenständige Firma ist, jedoch im Rahmen der Akkreditierung
durch die Akkreditierungstelle der Muttergesellschaft "mitakkreditiert" wurde, muss sie dann
für eine Notifizierung in D die Akkreditierung bei der DAKKS wiederholen?

Antworten ZLS:
1. Eine in einem EU-Mitgliedsstaat benannte bzw. notifizierte Stelle darf ihre Dienstleistun-
gen in allen EU-Mitgliedsstaaten anbieten und durchführen. Die Stelle ist als juristische Per-
son der KOM benannt, und genau für diese juristische Person steht auch die Nummer der
benannten Stelle. Eine unselbstständige Zweigniederlassung ist ein Standort der benann-
ten Stelle mitsamt Nummer. Wenn die Zweigniederlassung jedoch selbstständig ist, hat sich
die juristische Person geändert, und nach meinem (Dr. Tracht; ZLS) Wissen kann diese
Stelle dann auch nicht die gleiche Nummer aufweisen, wie die benannte Stelle. Sie müsste
sich also in diesem Falle einem Benennungsverfahren unterziehen.
2. Grundsätzlich gilt, dass eine Rechtsperson nur von "ihrer" nationalen Akkreditierungsstel-
le akkreditiert werden kann. Ausnahme ist, wenn die nationale Akkredditierungsstelle für
einen bestimmten Bereich nicht in der Lage ist dies zu tun, kann eine andere Akkreditie-
rungsstelle eines anderen Mitgliedstaates dies übernehmen (in Absprache mit der nationa-
len Akkreditierungsstelle).
So weit ich die Frage verstehe wurde die deutsche "Stelle" für Tätigkeiten für die ausländi-
sche "Benannte Stelle" mit begutachtet und in die Akkreditierung der ausländischen Stelle
mit aufgenommen.
Da es sich um eine eigenständige Rechtsperson in Deutschland handelt, die NB werden
möchte und dazu auch eine Akkreditierung vorlegen soll, kann es sich hier nur um eine
Akkreditierung durch die DAkkS handeln. In wie weit Ergebnisse der ausländischen Akkre-
ditierungsstelle mit berücksichtigt werden können, ist mit der DAkkS zu klären.

Wie wird aus einer Modul 2-Prüfstelle nach OrtsDruckV/TPED ein betriebseigener Prüf-
dienst (IS) nach ADR zur Prüfung von Druckgefäßen nach RID/ADR Unterabschnitt 6.2.2.9
u. 6.2.3.6? Gibt es neue Anforderungen?

Die Regelungen für betriebseigene Prüfdienste (ehemalige Bezeichnungen: "Modul 2-
Prüfstellen" oder "Unternehmensprüfstellen") sind detaillierter und umfangreicher geworden.
Die Unterabschnitte 1.8.7.6.1 und 1.8.7.7.5 des RID/ADR regeln die Pflichten der betriebs-
eigenen Prüfdienste bzw. die Überwachungspflichten der Prüfstellen, die die betriebseige-
nen Prüfdienste zulassen.
Die wichtigsten Auflagen für „betriebseigene Prüfdienste" (Kurzbezeichung „IS" gemäß Ta-
belle in Unterabschnitt 6.2.3.6.1 RID/ADR) sind:
- erstmaliges Audit durch Typ-A Prüfstelle
- Genehmigung für maximal 3 Jahre
- regelmäßige Nachaudits (zweimal jährlich) durch Typ-A Prüfstelle
- zusätzliche Besuche möglich
Für betriebseigene Prüfdienste in D entspricht dies bereits dem bisher schon auf freiwilliger
Basis üblichen Umfang der Überwachung durch Typ-A Prüfstellen.

Es entstanden im Publikum Fragen zur Übergangszeit. Es sind Konstellationen denkbar, in
denen eine Typ A akkreditierte Prüfstelle eine Modul-2 Prüfstelle weiterhin überwachen soll
bzw. umgekehrt eine Modul-2 Prüfstelle gerne betriebseigener Prüfdienst werden möchte,
jedoch die benannte Stelle noch nicht akkreditiert und notifiziert ist. Da die deutsche Ver-
ordnung über ortsbewegliche Druckgeräte noch nicht verabschiedet wurde. Es wird allge-
mein die Zuversicht zum Ausdruck gebracht, dass es in D eine praktikable Übergangsrege-
lung geben wird.

Nach derzeitigem Kenntnisstand wurde das Normungsprojekt zurückgezogen. Laut Aus-
kunft aus dem Publikum lag der Grund hierfür in einem zu geringen Interesse seitens der
ISO-Mitglieder.

Dürfen UN-zugelassene oDG ohne weitere Zulassungen/Beschränkungen in den
Landverkehr der USA?
Antwort F.2
Gemäß RID/ADR 1.1.4.2 dürfen aus den USA kommende UN-Druckgefäße mit DOT-
Zulassung für den Seeverkehr (Transportkette muss See-, Luftbeförderung einschließen) in
D befördert und entleert werden. Sie dürfen jedoch nach M 180 nicht wiederbefüllt werden.
Dies steht aber im Widerspruch zu den Regelungen nach TRG 402 oder TRG 405, die al-
lerdings für das Befüllen eine Reihe von Voraussetzungen formulieren.
Umgekehrt dürfen von Deutschland (oder EU) kommende Druckgefäße (z. B. deutsche UN-
Zulassung oder TPED-Zulassung) leider nicht in die USA eingeführt werden. Die USA er-
kennen die Zulassung von UN-Druckgefäße nur an, wenn es sich um vom DOT zugelasse-
ne UN-Druckgefäße handelt. Diese sind zu erkennen an der USA-Stempelung, zusätzlich
zum UN-Symbol. Reine TPED-Druckgefäße (nur Pi-gestempelt) werden grundsätzlich nicht
anerkannt. Die Möglichkeiten der M 180 bleiben davon unberührt.
Von einer vollkommenen Freizügigkeit in Bezug auf Befüllen, Beförderung, Entleeren und in
Bezug auf die Vermarktung kann also nur bei USA-UN-Flaschen mit zusätzlicher TPED-
Zertifizierung ausgegangen werden. Diese „Doppelzulassung" jedoch bringt dann wieder
Probleme bezüglich der wiederkehrenden Prüfung mit sich, es sei denn die Prüfstelle ist
von beiden zuständigen Behörden in den USA und Europa für die wiederkehrende Prüfung
von Druckgefäßen (USA-UN und TPED) zugelassen. Um sicher zu gehen, ist dann auch die
jeweils kürzere Prüffrist zu wählen.
In D gibt es Stellen, die vom amerikanischen DOT als „independent inspection agency" an-
erkannt sind. Diese Stellen können sicherlich detaillierte Auskünfte zu den Möglichkeiten
einer Neubewertung, zu den USA-UN-Zulassungen und weiteren Zulassungsfragen geben.
Die M 180 läuft am 02. Juni 2011 aus. Eine Nachfolgevereinbarung ist noch nicht in Vorbe-
reitung.
Diskussion F.2
Vor einigen Jahren sah es bereits so aus, als gäbe es eine schnelle gegenseitige Anerken-
nung der Transportzulassungen zwischen den USA und einigen RID/ADR-Staaten. Auf-
grund der unterschiedlichen Freizügigkeiten, die aus den Zulassungen nach RID/ADR ohne
TPED und US-DOT entstehen ist dieser Prozess aber bis heute nicht weiter gediehen.

Question A. 1
Portable fire extinguishers are not subject to the provisions of RID / ADR. Rather, they are
to be regarded as a presurized device in accordance with the 97/23/EC guidelines, however they should be transported according to the special criteria of 594 RID / ADR (see Guideline 24 for TPED).
For extinguishing agents for small firefighting systems, ready-assembled at the manufacturer an exemption from RID / ADR 1.1.3.1 letter b can be applied, and from the perspective of the enquirer could be exempted under "Exemption in connection with the type of transport operation ". The BMVBS however, is stated in the annexed statement, that an exemption on the basis of SV 594 is to be assumed.
Answer A.1:
Small extinguishing agent containers (up to 20 kg total mass) count both as a hand fire extinguisher
and as a fire extinguisher in terms of the special instruction 594 of the RID / ADR (packed and secured against unintentional operation).

Question A.2
Furthermore, we know wheeled extinguishers, which are known as permanent pressurized extinguishers, are (must be) transported under pressure. These are not covered by the exemption of the SV 594, which apply to portable fire extinguishers and would therefore have to be addressed under Guideline TPED 24 according to the RID/ADR. The draft standard prEN 1866:2006 Part 2, Annex A, however, assumes that in this case such devices are considered as pressurized devices in accordance with the 97/23/EC Guidelines (see attachment).
Similarly, for wheeled CO2 extinguishers, in which the extinguishing agent (carbon dioxide) is stored in steel cylinders the draft standard prEN 1866:2006 Part 3, Section 6.2 and Annex A, states that these are also pressurized devices in accordance with the 97/23/EC Guidelines.
From the perspective of the enquirer there is not a consistent system to be followed while handling extinguishers and containers of fire extinguishing agents, so that the enquirer would be happy to hear the opinions of experts in the course of a discussion.
Answer A.2:
For extinguishing agent containers / bottles with more than 20 kg total mass, a certification of pressure vessels according to TPED is necessary if they are to be carried as dangerous goods. A TPED certification is also required if there are ordinary pressure vessels involved, which can also be used for general purposes of transport of gases such as CO 2 bottles.
Should the extinguishing agent containers be intended for use in mobile or stationary extinguishing equipment or permanently built-in, the exemption shall apply in accordance with RID / ADR paragraph 1.1.3.1 b).

Demand for Incidents/Problems/Periodic Inspections of Paintball Bottles (Keyword DOT)
Answer A.3
Pressure vessels for paintball applications (especially those for commercial use) can be operating with significantly different filling and emptying frequencies and thus subject to fluctuations of load cycles, as is usually the case with the transport of dangerous goods with no more than 10-20 fillings yearly. This must be particularly observed in cases in which standards are meant for hazardous materials and the construction of such vessels using special pressure, because their application is not comparable to the transportation of compressed air or nitrogen. In any case the industrial safety regulations are to be observed. The responsibility of usage outside the application as containment for hazardous materials lies with the user.
In accordance with the RID / ADR 4.1.4.1 P200 Paragraph (9) the competent authority of the country, having approved the technical policies for layout and construction is responsible for the determination of the periodic inspections of the pressure vessels made of composite materials. This is in Germany according to RSEB 4-5.4 a) BAM, as Germany has formally recognized the relevant EN-Standards for the purpose of reference standards in RD / ADR. BAM defines a test period for pressure vessels for Paintball-applications in consultation with the BMVBS for every 3 years generally. Moreover, each review period comprises the following indications:
"The stipulation of the review periods only takes place in consideration with the safety requirements for the transport of dangerous goods for transport of composite pressure vessels in road and railway traffic. Such stipulations are therefore only for the purpose of safe transport.
If the composite pressure vessels are to be used for other purposes (eg temporary or permanent use in facilities with differing operating parameters such as Filling method, Fill frequencies, etc.) there will be additional provisions or other regulations (eg. for the handling, storage, usage and refilling itself) to be observed. This may possibly result in additional inspections, shorter inspection intervals, or otherwise calculated permitted usage durations. Regulations that do not deal with the transport
of dangerous goods shall not test or evaluate the official information for the determination of the inspection periods."
Paintball bottles, which have only a U.S. DOT certification must not be brought into circulation/be marked within the EU (the scope of the TPED). The private import and usage of such DOT-pressure vessels is not clearly established, however the refill - if not regulated differently in each individual case – is subject to the criteria such as the TRG 402 (cf. M 180 . For transportation in private vehicles, applies an exemption in accordance with RID / ADR Subsection 1.1.3.1 Paragraph a), similar to diving tanks. An appropriately qualified packaging and cargo security is a prerequisite for this exemption.
Discussion A.3
In connection with the keyword DOT-approval the public has been advised of the general difficulty in dealing with pressure vessels, which have no European or national accreditation, and the phasing out of the M180. See also question F.2.
Question A.4
The § 12 of the GGVSEB currently requires as a prerequisite for the inspection, the qualification as an ADR 6.2.1.6.1 ZÜS to GPSG and the designated location for transportable Pressurized Equipment.
In Paragraph 1.8.6.4 ADR 2009 the future checkpoint is designated as authorized, when accredited in accordance with the U-Sections 6.2.3.6 and the special provision TA4 and TT9 of the section 6.8.4 of EN ISO / IEC 17020:2004 .
If an international testing organization has been accredited after EN ISO / IEC 17020 as an inspecting authority in an "ADR-Land" (subsections 6.2.3.6 and the special provision TA4 and TT9 of 6.8.4 of EN ISO / IEC 17020:2004), will this then be recognized as an inspection body in terms of the ADR-regulations in Germany?
To clarify this, the following questions were sent to the Ministry of Safety equipment of the Countries (ZLS) by BAM:
1. A notified body in another Member State after the coming TPED has subsidiary in Germany. Must this branch be notified anew in Germany or this will depend on whether it is or not an independent company?
2. If this body is an independent company, but was accredited in the context of accreditation by the accreditation body of the parent company, must the accreditation then be repeated for a notification in Germany at the DAkkS?

ZLS answers:
1. A body, which has been notified or designated in any EU Member State is allowed to offer and perform their services in all EU Member States. The body is designated as a legal entity of the COM, and the number of the designated body is precisely for this legal entity. A dependent affiliate office is a location number along with the notified body. If the subsidiary is independent, however, the legal entity has changed, and according to my (Dr.
Tracht; ZLS) knowledge this entity cannot have the same number as the designated body. This subsidiary would have to undergo, in this case, a designation process.
2. In principle, a legal person may be accredited only by "their" national accreditation body. An exception is when the national accreditation body is not in the position to do so for a particular sector, in this case a different accreditation body of another Member State can undertake this (in consultation with the national accreditation body).
As far as I understand the question, the German "body" incorporated evaluation activities from the foreign "designated body" and was incorporated within the accreditation of the foreign offices.
Since it is an independent legal entity in Germany that is willing to become a NB and in addition to that would submit an accreditation, it can be here only an accreditation by the DAkkS. The scope of the results from the foreign accreditation body and if these can be considered, must be discussed with the DAkkS.

How will a 2-module inspection after OrtsDruckV / TPED become an in-house inspection service (IS) per ADR for testing pressurized vessels in accordance with RID / ADR subsection 6.2.2.9 and 6.2.3.6? Are there new requirements?

The regulations for in-house inspection services (Former designations: "Module 2-testing" or "testing companies") have become more detailed and extensive.
The sub-sections 1.8.7.6.1 and 1.8.7.7.5 of the RID / ADR regulate the responsibilities of the on-site inspection services and the monitoring duties of the testing bodies that allow the in-house verification services.
The most important requirements for "in-house inspection services" (abbreviated designation "IS" according to the Table in sub-section 6.2.3.6.1 of RID / ADR) are:
- Initial inspection through type-A Testing
- Approval for up to 3 years
- Regularly re-inspect (twice a year) through type-A Testing
- Possible additional visits
For in-house testing services in Germany the Type A testing meets the scope of monitoring on a voluntary basis.
A.5 Discussion
Questions about the transitional period have risen among the audience. Combinations are conceivable, where a Type A monitor Accredited Laboratory should monitor a Module A-2 testing, or vice versa, a module-2 Testing body wants to become an independent inspection house, but is not yet a designated and accredited body. Since German Law on transportable pressurized equipment was not yet adopted. The confidence is generally expressed that there will be a viable transition regulation in Germany.

Based on the current information, the standardization project was withdrawn. According to information from the public the reason for this stemmed from an insufficient interest among the ISO members.

Are the oDG approved by the UN allowed for ground transport in the USA without further authorization / restriction?

In accordance with the RID / ADR 1.1.4.2 UN pressure receptacles from the US with DOT
Approval for maritime transport (transport chains must include maritime and air transport) may be transported in and emptied in Germany. However, according to the M 180 they should not be refilled.
Nevertheless, this is contrary to the provisions of the TRG 402 or 405, which formulates a number of conditions for the filling.
Conversely, pressurized vessels from Germany (or the EU) (eg German UN approval or TPED approval) are unfortunately not allowed to be imported into the United States. The U.S. recognizes the approval of UN pressure receptacles only if they are UN pressure receptacles approved by DOT. These are recognized by the U.S. marking, in addition to the UN symbol. Pure TPED pressure vessels (only Pi-stamped) are strictly not accepted. The possibilities of M 180 are not affected.
Freedom of movement in terms of filling, transporting, and emptying in relation to the commercialization can therefore be considered only in USA-UN-cylinders with additional TPED certification. However this "double approval" results in problems concerning the periodic inspections, unless the laboratory is approved by both competent authorities in the U.S. and Europe for the recurrent inspections of pressure vessels (USA-UN and TPED). To be on the safe side, the shorter inspection period is to be chosen.
There exist bodies in Germany, that are recognized as "independent inspection agencies" by the American DOT. These entities can certainly give detailed information on the possibilities of a re-evaluation of the US-UN approvals and on other regulatory matters.
The M 180 expires on the 2nd June 2011. A Follow up has not yet been prepared.

A few years ago it looked as if there was already a rapid mutual recognition of transport certifications between the U.S. and some RID / ADR countries. Due to the differing freedoms of mobility that arise from the RID / ADR Certifications without TPED and U.S. DOT, this process has not developed.
