Source text - English 2.2. Fehlerbehebung:
2.2.1. Treten Fehler auf, hat der Kunde diese unverzüglich in nachvollziehbarer Form unter Verwendung des bereitgestellten Problemmeldungs-Formulars (siehe Anlage 2) zu melden. Bei einer telefonischen Fehlermeldung ist der Kunde verpflichtet, die schriftliche Fehlermeldung unverzüglich nachzureichen. Voraussetzung für den Anspruch auf Fehlerbeseitigung ist in jedem Fall, dass der Fehler reproduzierbar ist oder durch maschinell erzeugte Ausgaben aufgezeigt werden kann.
2.2.2. Ein „Fehler“ der ###anonymous### - Software liegt vor, wenn:
2.2.2.1. die Software-Funktionen nicht entsprechend dem vertraglich vorausgesetzten oder üblichen Gebrauch erfüllt werden;
2.2.2.2. die Software unrichtige Ergebnisse produziert, die nicht auf Fehlbedienung zurückzuführen sind;
2.2.2.3. der Programmablauf der Software unkontrolliert unterbrochen wird;
2.2.2.4. in anderer funktionswidriger Weise die Softwarenutzung beeinträchtigt oder verhindert wird.
2.2.3. ###anonymous### ist verpflichtet, gemeldete Softwarefehler unverzüglich zu beseitigen. ###anonymous### wird mit den hierzu erforderlichen Maßnahmen ohne schuldhaftes Zögern beginnen und dem Kunden mitteilen, mit welcher voraussichtlichen Dauer der Fehlerbeseitigungsmaßnahme zu rechnen sein wird. Zur Fehlerbehebung gehören:
2.2.3.1. Eingrenzung der Fehlerursache
2.2.3.2. Fehlerdiagnose
2.2.3.3. Beseitigung des Fehlers
2.2.3.4. ggf. Herstellen der Lauffähigkeit der Software durch Umgehen des Fehlers (Durchführung temporärer Maßnahmen)
2.2.3.5. Die konkrete Fehlerbeseitigungsmaßnahme wird in den Räumen von ###anonymous### durchgeführt und dem Kunden im Wege der Fernwartung zur Verfügung gestellt. ###anonymous### hat jedoch auch das Recht, dem Kunden Fehlerbe-seitigungsmaßnahmen per E-Mail mitzuteilen; der Kunde wird diese dann auf seiner Anlage übernehmen.
Translation - German 2.2. Fixing Errors:
2.2.1. If an error occurs the customers is obliged to immediately record the error using the problem report form provided in enclosure No.2 and report it to ###anonymous### immediately. In case of an error reported via telephone, the customers are obliged to deliver the written error report to ###anonymous### immediately afterwards. ###anonymous### is only responsible for fixing errors that are recurring, or can be shown in machine-generated output.
2.2.2. The following problems constitute an error of the ###anonymous### software:
2.2.2.1. If the software does not function as contractually agreed, or as it ought to under normal circumstances;
2.2.2.2. If the software produces false results that are not the result of erroneous operation;
2.2.2.3. If the operation of the software is self-interrupted;
2.2.2.4. If the use of the software is impaired or prevented in any way outside the normal function of the software;
2.2.3. ###anonymous### is obliged to fix reported errors immediately. ###anonymous### will initiate the required measures without culpable hesitation and inform the customers of the estimated duration of the repair. Fault removal is made up by the following steps:
2.2.3.1. Locating the source of the error;
2.2.3.2. Error diagnosis;
2.2.3.3. Removal of the error;
2.2.3.4. If applicable, restoration of the operation of the software by bypassing the error, as a temporary measure;
2.2.3.5. The actual fixing of the error takes place in the ###anonymous### offices and is provided to the customers via remote maintenance. However ###anonymous### reserves the right to inform the customers of error fixing measures which the customers will then carry out on the customers’ system via e-mail.
