La véritable révolution portée par ce nouveau contentieux demeure l’allègement du fardeau de la preuve pour celui qui veut faire cesser les conséquences préjudiciables de l’exercice abusif de la liberté d’expression. En effet, en cas de litige, le réseau social devient le « royaume de la preuve ».
Or, en s’entourant de peu de précautions pour accueillir ces modes de preuves, les magistrats semblent ignorer qu’il est très simple de falsifier une page Facebook, voire de la pirater ponctuellement. Cette admission soulève deux difficultés : celle de l’origine du document électronique d’une part et celle de l’obtention de celui-ci d’autre part.
Premièrement, il n’est pas sûr qu’en présence d’un message posté sur un « wall » Facebook « puisse être dûment identifiée la personne dont il émane et qu’il soit établi et conservé dans des conditions de nature à en garantir l’intégrité. » Deuxièmement, rappelons qu’en principe, la preuve doit être obtenue loyalement . Il en résulte notamment qu’au civil comme au pénal la preuve obtenue par « un procédé déloyal (rend) irrecevable en justice la preuve ainsi obtenue ».

The judges, who took few precautions when accepting these forms of evidence, seem unaware that it is very easy to falsify a Facebook page or even repeatedly hack into one. There are two difficulties here: the origin of the electronic document on the one hand, and how it was obtained on the other.
Firstly, as regards a message posted on a Facebook ‘wall’, it cannot be assumed that the person who wrote it can be duly identified, nor that it can be established and conserved in conditions guaranteeing its integrity. Secondly, let us not forget that, in principle, evidence must be obtained fairly. A notable result of this is that, in both civil and penal matters, evidence obtained unfairly makes it inadmissible.

It meets its objective by explaining how it sees the current democratic deficit: the lifestyle, technology, means and expectations of the ‘governed people’ of our democracies have changed a great deal since the establishment of representative democracies in the 19th Century. The original context of and reasons for choosing representative democracy as a method of governance have been transformed by new technology which enables more efficient communication; in the past, steam trains, horse-drawn carts, Linotype, telegraphs and the early radio mumblings necessitated a compromise between the ideal of direct democracy and what could practicably be done via elected representatives.
