Concurrent jurisdiction
1. The Internacional Tribunal and nacional courts shall have concurrent jurisdiction to prosecute persons for serious violations of international humanitarian law committed in the territory of former Yugoslavia since January 1991.
2. The International Tribunal shall have primacy over national courts. At any stage of the procedure, the International Tribunal may formally request national courts to defer to the competence of the International Tribunal in accordance with the present Statue and the Rules of Procedure and Evidence of the International Tribunal.
Article 10
Non-bis-in-idem
1. No person shall be tried before a national court for acts constituting serious violations of international humanitarian law under the present Statue, for which he or she has already been tried by the International Tribunal.
2. A person who has been tried by International courts for acts constituting serious violations of international humanitarian law may be subsequently tried by International Tribunal only if:
(a) the act for which he or she was tried was characterized as an ordinary crime; or
(b) the national court proceedings were not impartial or independent, were designed to shield the accused from international criminal responsibility, or the case was not diligently prosecuted.
3. In considering the penalty to be imposed on a person convicted of crime under present Statute, the international Tribunal shall take into account the extent to which any penalty imposed by national court on the same person for the same act has already been served.
1. El Tribunal Internacional y los tribunales nacionales tendrán jurisdicción concurrente para enjuiciar a personas por violaciones graves del Derecho Internacional Humanitario cometidas en el territorio de la ex Yugoslavia a partir del 1 de enero de 1991.

Source text - English 1. EXECUTIVE SUMMARY
According to its press releases, XXX, Inc. is one of the largest marketers of branded rice products in the United States and internationally. XXX began as a Texas agricultural cooperative marketing association formed in 1969. In 1988, it became a publicly held business corporation. In that transaction, the farmer/owners of the old XXX received 52% of the outstanding stock of the publicly held corporation, and the other 48% of that stock was issued to AAA, Inc., which was then owned by EEE Industries, Inc. EEE was controlled by GM and his son, DM.
In August 1998, XXX filed for bankruptcy under Chapter 11 of the Bankruptcy Code. It emerged from this bankruptcy as of October 1, 1999. As a result of the bankruptcy, XXX settled its accounts with its creditors, all of XXX's obligations under contracts were voided, with the exception of those contracts that were listed with the bankruptcy court documents, and all of the old XXX’s stock was cancelled.
Also as a result of the bankruptcy, XXX became a Delaware corporation owned by its former bondholders and XXX ceased to be a publicly reporting company under federal laws. Apparently, XXX is still making payments to its former creditors as a result of the bankruptcy.
When XXX emerged from bankruptcy, it entered into a credit agreement with GMAC Commercial Credit L.L.C., Foothill Capital Corporation and Far East National Bank, providing for a $25,000,000 term loan and a revolving line of credit, with a maximum commitment of $60,000,000. All of XXX’s assets were pledged to secure XXX’s obligations under the credit facility. In addition, the credit agreement provides that XXX may not "enter any merger". A breach of the covenants under the credit agreement is an event of default, which means that the lenders have the right to require that all of the obligations under the credit facility are immediately due and payable and to terminate the credit facility. The credit agreement is discussed in more detail in Part IV of this Memorandum and in Attachment O to this Memorandum.
