English to Spanish Law/Patents Law: Contract(s)
"the company shall not dispose of his undertaking and another assets except by getting in and realising them in the ordinary course of its business."

It is one of the clauses of a debenture. I have been making searches and found many instances of "getting in and realising", but am unable to find a satisfactory meaning for getting in in any dictionary, apart from entering into the possession, which does not seem to fit with its use in another clause which refers to "not to deal with debts.... by getting in" Any help would be very much appreciated.

It's just a formula in business You should have put the whole expression, "getting in and realizing", which, mostly referring to assets, is the counterpart of the formula in Spanish "adquisición y liquidación" de bienes.

getting in i think that in this case it would be applicable to the administrator appointed by the lender (as stated in the debenture), which would be a figure more similar. But I somehow do not see how it applies to the company with regard to its own assets and the things it can do with them... But I think this entry is great and very helpful and may be it's just late here

getting in A phrase usually used in relation to executors of an estate. The implication is that efforts have to be made to detect and obtain possession of all the deceased's assets. Doubtless same meaning here, mutatis mutandis.

Sorry,

"The company" is the debtor. This debenture charges its property and assets with a guarantee to the lender as a security for the payment. The clause stated in the question is one of the covenants listing the things the Company is not allowed to do (in order to protect the security)

I believe that the whole expression means that the company may nor get rid off its assets by any other means other than liquidating them through its normal course of business (in order to use the proceeds to pay off the debt).

adquisición y liquidación

"Getting in and realizing" (o con "s", dependiendo del lado del Atlántico) es una expresión en negocios equivalente a la española "adquisición y liquidación".

Yo ahí diría:

"La compañía no podrá disponer de su firma y otros bienes excepto mediante su adquisición y liquidación durante el curso normal de sus operaciones comerciales".

Gracias por la nota, Cbcn. No, la excepción no se encuentra en la adquisición en sí, sino en el hecho de que ésta (o la liquidación) se lleve a cabo durante el curso normal de las operaciones comerciales de la empresa. Ésa es la excepción.

Si con lo de "couplet" te refieres a que "getting in and realizing" van juntos en esta expresión, coincido totalmente y así lo he dicho desde que contesté a tu pregunta. De hecho mi respuesta la di con la fórumula en español completa (adquisición y liquidación), lo que tú erroneamente llamas "couplet" (ya que no se trata de un poema, ni de versos líricos); y así lo hice constar también en el área de discusión.

Yo sigo sosteniendo que "getting in and realizing" en español es "adquisición y liquidación". Sólo me queda una curiosidad: ¿cómo lo tradujiste tú? No se me ocurre otra manera en que se pueda trasladar una fórmula de ese tipo que con una equivalente en el idioma meta.

Muchas gracias, al final, dudando mucho, opté por la idea del couplet pues no me cuadraba la idea de incluir una aquisición como excepción a la prohibición a las facultades de disponer.
Gracias a ti por tus comentarios. Quería decir doublet pero después de 16 páginas sin puntos ni comas mi cerebro debíaestar afectado pues veo que no me salió lo que quería...
