French term

analyse

French to English Law/Patents Transport / Transportation / Shipping contract of carriage
Par laissé-pour-compte, on entend l'envoi dont le destinataire a refusé de prendre livraison pour quelque motif que ce soit et qui est laissé à la disposition du transporteur par le donneur d'ordre, lequel l'analyse en perte totale.

This is in the terms & conditions of a contract of carriage and seems to be have been lifted verbatim from the official legal text

However I just don't get what it's talking about, so any light you can shed on it for me would be most welcome.

Discussion

Alain Pommet (asker) Sep 7, 2010:
Covering the carrier I was just wondering if this covers the carrier from any liability - maybe in fact the "donneur d'ordre" can get the goods back in most cases, but this is a way of absolving the carrier from any responsibility if things go wrong. These are after all the carrier's terms & conditions.
Graham macLachlan Sep 7, 2010:
hmm but surely if the goods are "laissé à la disposition du transporteur par le donneur d'ordre" the latter has washed his hands of them
Alain Pommet (asker) Sep 7, 2010:
thanks polyglot
polyglot45 Sep 7, 2010:
he treats it as a total loss in the sense that he writes it off - if afterwards another home is found for the consignment, that would be a bonus
Graham macLachlan Sep 7, 2010:
I'm sure insurance would be involved
Alain Pommet (asker) Sep 7, 2010:
At a total loss -me! Thanks for your answers. So are you all saying that the 'donneur d'ordre' just leaves the consignment in the hands of the carrier and writes it off - basically dumping it leaving the carrier to do whatever it wants with the consignment?

write-off

Hi Alain, my take from the context.

The word "analyser" does suggest "to break down" like "décomposer" which could be taken as "to enter into one's accounts"

recognizes

In this case, my best guess is that it means that accounting-wise, it must be "recognized" as a total loss.
