Die Beklagt beabsichtigt lediglich, in dem vorliegenden Verfahren die Rechtmäßigkeit ihres Verhaltens klären zu lassen. In ihrer Rechtsverteidigung liegt keine Berühmung:
"Die Tatsache allein, dass sich ein Beklagter gegen die Klage verteidigt und dabei die Auffassung äußert, zu dem beanstandeten Verhalten berechtigt zu sein, ist jedoch nicht als eine Berühmung zu werten, die eine Erstbegehungsgefahr begründet (vgl. I have looked at the posts for "sich berühmen" and know that it means to make a claim. I understand that they are simply trying to defend the legality of their actions. For the "ist jedoch nicht als eine Berühmung zu werten", would it be too far to say that their defence shouldn't be viewed as a "boast" or is there a more fitting (official) legal term for this?
