Term comes from Iberian Spanish document describing legal dispute over patenting. Section refers to appeal lodged by legal representative, who cites inadequate reasoning and "incongruencia extra petitum" as motives for the appeal against the previous judgement.

Personally I would stick with the Latin phrase as it is used and lawyers would understand it.

Another interesting issue was raised in decision 97/ 2012 on the grounds of an alleged ‘extra petitum’ based on Article V 2 (b) NYC in relation with Article 24 of the Constitution. The Court confirmed the distinction between ‘extra petitum’ or excess of the award with respect to the arbitration agreement and the ‘extra petitum’ or excess of the award with respect to the statement of claim. Finally, the Court accepted the application and granted the recognition because it considered that the award had
granted even less than what was claimed.

neutral Billh : This is a Spanish thing and your examples are all from Spain. Lawyers may or may not understand it, they would just guess, nobody else would understand it though without an explanation.

Thanks for your input Bill. If it were my translation I would probably use the Latin term and explain it as well.
