Nach dem wegen Patentgesetz § 59 Abs. 3 auch im Einspruchsverfahren geltenden § 47 Abs. 1 Satz 3 bedarf es jedoch keiner Begründung des Beschlusses, wenn, wie im vorliegenden Fall, am Verfahren nur noch die Patentinhaberin beteiligt ist und ihrem Antrag stattgegeben wird.
Die Prüfung durch die Patentabteilung hat ergeben:
Der zurückgenommene Einspruch war frist- und .formgerecht erhoben worden und ist auch sonst zulässig.
Das Patentbegehren ist zulässig.
Der Gegenstand des Patentanspruchs 1 ist gegenüber dem ***im Verfahren befindlichen Stand der Technik*** neu und beruht auf einer erfinderischen Tätigkeit.

Does this make sense, do you people think? Or do they talk about the examination procedure there ("the prior art that has been introduced into the examination procedure")? Other?
