Spanish term

Fianza de responsabilidad civil

Spanish to English Law/Patents Law (general)
Hola, colegas:

liability bond (or) civil liability bond, bond to cover (possible) civil liability, etc.

This is not a fine and it may seem strange in common law jurisdictions in which civil and criminal liability are usually adjudicated in separate civil and criminal trials. In Spain both criminal liability and any civil liability arising from the criminal offense in question are usually determined in the same (criminal) proceeding. Thus, judges often demand that a bond be posted to cover possible civil liability determined during a criminal trial.

In other respects, it would be helpful if you actually post the text that you are translating so that we can have more context. Thanks!

Thanks philgoddard
agree Jennifer Levey : Yes - and preferably one of your expressions including 'civil', to facilitate understanding by readers more accustomed to the civil/penal separation encountered elsewhere.

Bail IN civil liability is more common usage than bail FOR civil liability
Peer comment(s):

neutral philgoddard : I'm not sure if bail is the right word if it's for civil liability.

neutral Rebecca Jowers : I have to agree with philgoddard. "Bail" is security to avoid or to be released from pretrial detention, a circumstance that doesn't apply to the Infanta.

neutral AllegroTrans : Bail applies in criminal proceedings, wrong term for civil liability cases
