El daño emergente es un tipo de perjuicio material. Consiste en la pérdida efectiva -pasada, presente o futura- de un bien económico que se encontraba en el patrimonio de la víctima. En consecuencia, comprende una amplia cantidad de rubros, desde la destrucción total de un objeto, hasta las erogaciones o desembolsos patrimoniales que la víctima realiza o tendrá que realizar producto del hecho dañoso. El daño emergente se encuentra definido en el artículo 1614 del Código Civil.
