I am having problems deciphering the sense of, and hence providing an appropriate translation for, "ausfallen" in the following:
"Dies gilt auch schon vor der Eintragung der Grundschuld im Grundbuch und vor der Vollstreckung in das belastete Grundeigentum sowie für den Fall des Erlöschens der Grundschuld im Zwangsversteigerungsverfahren hinsichtlich des Betrags (Kapital, Zinsen, Nebenleistungen, Kosten), mit welchem die Gläubigerin hierbei ausgefallen ist."

While agreeing with Ellen's colloquial idea: cf. Robert Herbst's dictionary translation of 'remain unpaid', I don't think the German is weird, rather an insolvency term of art that needs an appropriate bnakruptcy label in EN, like out of contention or 'out of the running'.
Here, after the landcharge has been extinguished, the Gläbigerin (corporate or female) creditor is left unsecured, out of the picture and relegated as an unsecured creditor off the list of creditors queuing or lining up for payment.
