Ermessen = discretionary but I cannot find any suitable translation of the term "Ermessensleitung" (and then how it relates to "Ermessensbindung"

Es geht hier um die Prinzipien, von denen sich die Behörde bei Ausübung ihres Ermessens LEITEN lassen soll. Die Prinzipien sind hier Effizienz und Leistungsfähigkeit des Verkehrs.

Tatbestandsebene und Rechtsfolgenebene sind die zwei Ebenen, aus denen sich jede Rechtsnorm zusammensetzt.

Ermessensleitung could be a typo for Ermessensleistung, discretionary payment. But unless the other items are about stamp collecting or nuclear physics, they should provide some extra context.

factors to be considered when exercising discretion

Hi Claire,

In English this has to be completely rewritten. What it means is that (from the author's perspective) greater specification is needed of the factors an authority should consider when its exercising discretion - here "leitung" is in the sense of "directing" - the factors are the Tatbestandsebene - so the authority should be given greater direction on the factors to be considered. In addition, it should have its discretion reduced "bindung" in terms of the consequences i.e. no longer an authority "may" ... but an authority "should"...
