factors to be considered when exercising discretion
Hi Claire,
In English this has to be completely rewritten. What it means is that (from the author's perspective) greater specification is needed of the factors an authority should consider when its exercising discretion - here "leitung" is in the sense of "directing" - the factors are the Tatbestandsebene - so the authority should be given greater direction on the factors to be considered. In addition, it should have its discretion reduced "bindung" in terms of the consequences i.e. no longer an authority "may" ... but an authority "should"...

Discussion
The rest of the list is completely different in context.
This looks like it may be a heading, since it's not a complete sentence. If so, what does it say underneath?
