Mexican court documents from Guerrero state referring to the cancellation of a warrant. I can find 'reaprehension' in no dictionary. Do they simply mean 'arrest warrant'?

@ Chris - I Like you, I can find 'reaprehension' in no dictionary and it seems that this is a particularity of Mexican law and they make a fine distinction between arrest and apprehension. I don't think that this is an arrest warrant in terms of Mexican law. If you see in my reference below, which is from a Mexican lawyer's firm: 'Arresto: Procede al inicio de la investigación del delito' or in the Wikipedia definition in my answer: 'Unlike a basic arrest warrant, a bench warrant is not issued to initiate the first criminal action'. It is clear that there has already been a previous order in this case.

I don't know what would be the statute of limitations period for an arrest order in the USA but my reference below says that an apprehension order should last 24 hours, 8 hours or unknown for the 3rd case depending on the classification.

However, IMO, this would be a subsequent/second/new bench warrant or re-apprehension order if you want to use the literal translation.

It looks suspiciously to me like a 'bench warrant'. I can't say I've ever heard of a 're-arrest order' but, then again, I am not wearing my Mexican sombrero.

Órdenes de Aprehensión

La orden de aprehensión (bench warrant) es una orden de detención inmediata. La orden de aprehensión es una orden judicial de detención que se expide en contra de un individuo que no ha comparecido en un juzgado en la fecha y hora pactadas, o cuando éste no ha pagado una multa. DOC records indicate that by 12:12 PM on April 6, it had issued an apprehension order for Mr. Jackson and had notified the Madison Police Department by 12:39 PM. DOC also issued a second apprehension order on April 9. Mr. Jackson was apprehended on the morning of April 10.

MERIDEN — A rearrest warrant was issued for a city man charged with voyeurism after he did not appear in court on Thursday.

Anthony Diskin was arrested Feb. 21 and charged with voyeurism. According to court records, a judge ordered a re-arrest warrant for Diskin after he failed to appear in Meriden Superior Court. The judge issued a $10,000 bond for the new warrant.

Orden de arresto (vs. orden de aprehensión)

Mexico is the only country I know of that has two different terms that mirror the US usage, i.e., one for a warrant based on probable cause the other for a warrant based on the bench’s own cognition. The term orden de reaprehensión makes perfect sense unto itself since it denotes that the person was already aprehended and now there is an order to re-aprehend the same person. Nonetheless, the term orden de reaprehensiónis only used once in the new Mexican National Criminal Procedure Code (2014) and we may see a shift away from using this term. ¿En qué casos se puede privar de libertad a una persona?

Durante el proceso penal se puede privar de libertad a una persona, por medio del uso de las siguientes medidas cautelares: el arresto, la aprehensión y la detención preventiva. Además, se puede privar de libertad a una persona cuando ésta tiene una sentencia ejecutoriada que la condene a una pena.
En cualquier otro caso, la privación de libertad es ilegal y por lo tanto el agraviado puede acudir ante las autoridades judiciales para que lo pongan en libertad.

1) Arresto: Procede al inicio de la investigación del delito cuando no es posible identificar a los autores, participes y testigos del hecho y existiendo riesgo de perjudicar dicha investigación, no pudiendo exceder de 8 horas. (Art. 225 – Código Penal; Ley 1768 de 1997) En resumen, según Osorio, el arresto es la detención provisional del presunto autor de un delito.

2) Aprehensión Existen 3 casos en los cuales procede la aprehensión:
• Por la Fiscalía: Procede cuando es necesaria la presencia del imputado, debido a que existen indicios suficientes que señalan que es autor o participe de un delito de acción pública con mínimo legal igual o superior a dos años, y existe riesgo que pueda ocultarse, fugarse o ausentarse del lugar donde se encuentra así como el riesgo que pueda obstaculizar la verdad. Su duración es de 24 horas para poner el imputado a disposición del juez, que resolverá en dicho plazo la otra medida cautelar.
• Por la Policía: Procede cuando quien cometió el delito ha sido sorprendido en flagrancia; en cumplimiento de un mandamiento de aprehensión ordenado por juez o tribunal competente; por orden que emana de fiscal o en caso de fuga luego de haber estado detenido. Su duración es de 8 horas (Art. 227 – Código de Procedimiento Penal)
• Por Particulares: conforme al Art. 229 del Código de Procedimiento Penal boliviano, en caso de flagrancia (que se encuentre al autor de un delito mientras está ejecutando la acción delictiva, o durante su fuga) los particulares están facultados para practicar la aprehensión, debiendo entregar inmediatamente al aprehendido a la policía, a la fiscalía o a la autoridad más cercana.
