I surmise that this something to do with 'voluntary (agreed) jurisdiction', to wit: non-contentious business with probate (Scots law: letters of confirmation) issued in 'common' (undisputed) vs. 'solemn' (litigious) form, rather than a settlement like a DoFa: a Deed of Family Arrangement e.g. of Variation of a Will out-of-court.

: I think "out of court" implies that there's been a dispute. I'd just say "non-contentious"..

Thanks. The problem is that non-contentious business is handled in court anyway, namely in London by the Probate Registry of the Family etc. Division of the High Court.
