Schriftformheilungsverpflichtung

German to English Law/Patents Law: Contract(s) Lease agreement
Beide Parteien sind verpflichtet, alle Handlungen vorzunehmen, die zur Einhaltung der ggfs. für diesen Vertrag oder für Nachträge zu diesem Vertrag zu beachtenden Schriftform gemäß § 550 BGB erforderlich sind.
Andernfalls darf sich die jeweilige Partei nicht auf die Nichteinhaltung der Schriftform berufen, insbesondere den Vertrag nicht unter Berufung auf die Nichteinhaltung der Schriftform kündigen.
Diese Schriftformheilungsverpflichtung gilt nicht zulasten eines Erwerbers, der gemäß § 566 BGB oder aufgrund von Vorschriften, die auf § 566 BGB verweisen, in das Mietverhältnis als neuer Vermieter eintritt.

No to handwriting I studied law in Germany and I can only confirm what Adrian and Steffen have said.

Schriftliche Form or Schriftform does not mean something has to be written by hand. You can type it all up on the PC; you just have to sign it.

See also the English translation of Sec. 126:
"If written form is prescribed by statute, the document must be signed by the issuer with his name in his own hand, or by his notarially certified initials."

Here, it simply means that you can't terminate the contract or change terms just because nothing was written down.

A contract is a contract, regardless of whether it is in writing.

Handwriting is but one written form I fully agree with Adrian - this is about (not) adhering to a written form of any kind. Handwritten documents are rarely used nowadays in a contractual context.

Austrian ABGB. Even in the latter case, the Will may be made orally, for instance in a pub or bar and if attested to by at least 3 witnesses.

§ 126 BGB (3) Die schriftliche Form kann durch die *elektronische* Form ersetzt werden, wenn sich nicht aus dem Gesetz ein anderes ergibt.

agree Timothy Wood : This is a nice variety of solutions, and, if I had to pick, I would choose the combination "obligation to cure violations of handwritten form requirements". It's awkward and long, but I think it's fairly representative of what the German phrase means.

Basically Andres-L's idea, but the 'lack of' needs spelling out- in writing.
