Sąd uznaje, że zastasowanie ekstradycji byłoby rozwiązaniem niewspółmiernym do przestępstwa/kary i dlatego też oddala wniosek o ekstradycję. Osoba, której dotyczy ENA nie będzie ekstradowana.

W razie zaistnienia chociażby jednej z takich okoliczności, sąd okręgowy rozpoznający sprawę zobligowany jest więc do wydania postanowienia o odmowie wykonania nakazu europejskiego - czyli odmowy przekazania osoby ściganej; postanowienie to, na mocy art. 607l § 3 k.p.k., oczywiście jest zaskarżalne zażaleniem.

Komisja Europejska wydała podręcznik „Jak wystawiać europejski nakaz aresztowania?”
W tym dokumencie natomiast w kilku miejscach discharge jest tłumaczone jako zwolnienie, innego tłumaczenia nie ma.

Czyli najczęściej sprawa jest oddalana ze względów formalnych czy proceduralnych - The case is dismissed on a technicality. nb mogli byli użyć dismissed zamias discharge, wtedy wszystko byłoby jasne :/
- discharged from custody - tu sprawa jest jasna, chodzi o zwolnienie z aresztu lub innego środka zapobiegawczego -- tu pasuje propozycja Franka
- "Material seized in relation to the extradition offence shall be retained only until: (a) the person’s extradition is ordered and the extradition proceedings are completed; or (b) the person is discharged; (c) the extradition request is refused or withdrawn"

Problem w tym, że tutaj słowo 'discharge' jest dość mocno związane z 'person'. Jeśli moglibyście spojrzeć na moje referencje, sprawa nie jest jednak taka oczywista. Chyba najlepszym wyjściem byłoby skonsultować się z prawnikiem w UK, który jest zaznajomiony z brytyjskim Extradition Act oraz unijnym EAW i tym jak słowo 'discharge' funkcjonuje w jednych i drugich przepisach.

W takim razie ,,umorzenie postępowania ekstradycyjnego" - tak jak mówisz.
Żądanie to zostało
zmodyfikowane w toku postępowania, mianowicie na rozprawie w dniu 11 maja
2016 r. E.N. wniósł o zasądzenie zadośćuczynienia za krzywdę w kwocie 180.000
zł oraz odszkodowania w kwocie 220.000 zł z tytułu utraty zarobku i niemożności
podjęcia pracy, zaś pismem z dnia 8 sierpnia 2016 r. pełnomocnik wnioskodawcy,
podtrzymując to żądanie wskazała, że na jego ocenę powinien rzutować cały okres
stosowania wobec wnioskodawcy tymczasowego aresztowania w postępowaniu
ekstradycyjnym.
