Montana requires a worldwide combined return for unitary groups of affiliated corporations unless an election to file on “water’s edge” basis has been made. A “water’s edge” election typically only includes income that is generated in the US. In order to file on “water’s edge” basis in Montana, a Montana Water’s Edge Election (Form WE-ELECT) must be filed with the Montana Department of Revenue, which is (in essence) an application requesting approval by the Montana Department of Revenue to file on “water’s edge” basis. If the Montana Department of Revenue grants approval, it is binding on the taxpayer/filer for three years. Based on our reading of the Target’s Montana corporate income returns provided for our review, the Target did not indicate that it filed on a water’s edge basis and the Water’s Edge Schedule (WE-Schedule) was not included with the returns filed, as required (the Water’s Edge Schedule, in essence, removes income from foreign operations of US entities so that the final income reflected will be only US income).

Kocham proZ. Wczoraj nie miałam pojecia, że istnieje cos takiego w prawie podatkowym jak "water's edge". Sama nie miałam czasu tego przerobić, ale na niektórych zawsze można liczyć. Choć to nie moje pytanie, dziekuję.

BTW można przetłumaczyć dosłownie. Aby wymyśleć coś innego, trzeba znać historię powstania tej nazwy (może być w moim linku, nie wczytywałem się dokładnie).

Podany kontekst IMO nie uzasadnia takiego wysiłku - chyba, że dla własnej satysfakcji tłumacza ewentualnie, gdy klient naciska "Ale skąd, dlaczego, po co, na co... ???". ;-)

IMO nie ma potrzeby wymyślać polskiego określenia. Sugeruję potraktować "water's edge" jako nieprzetłumaczalną nazwę własną.

It means on the basis of

A water’s edge election basically says that you (as a business or entity) agree to be taxed within the jurisdiction for the sales that occur within that state, but only within the parameters of that state. The goal is to reduce the total tax owed for conducting business in a jurisdiction outside of the “home” of the associated taxpayer or company. If a business does not make that election, for example if you are a California corporation and you are doing business in Oregon and Washington, if you do not claim appropriate “water’s edge” elections then California can go back and lay claim to all of those sales (and apply associated taxes).
