"Supremo Tribunal Administrativo tem entendido (vide Acórdão de 19.11.2008, Proc.0 n.° 0325/08 in www.dqsi.ptV que "quando uma determinada conduta constitui um facto qualificado por lei como ilícito, deverá fazer-se decorrer do preenchimento da hipótese normativa, por ilação lógica, a existência de culpa, na forma pressuposta na previsâo do tipo de ilícito respectivo."

I would change the word order because it is not usual to use the same word order in English. Here is my suggestion:
(the finding of guilt) must accrue (by logical illation) pursuant to the normative hypothesis
NOTE: My confidence level is not high because I actually translated the phrase, while the asker is looking for the equivalent in English. There could be a more common way to saying that in legal settings.
