- On 11 November 2004 the applicant filed a request for the re establishment of his pension with the Fund for Social Insurance of Military Beneficiaries (Fond za socijalno osiguranje vojnih osiguranika, “the Serbian Fund” or “the Fund”). On 11 March 2005 the Fund refused the request, finding that according to Article 82 of the Pension and Disability Insurance Act the applicant only had the right to choose the pension fund once, and he had already used this right by transferring his pension to Croatia in 1994.

Chapter 24. GEORGIA MILITARY PENSION FUND
- All persons who are members of the Georgia National Guard on July 1, 2002, shall become members of the fund as of such date. All other persons shall become members of the fund on first becoming a member of the Georgia National Guard.

Pension and Disability Fund for Military Beneficiaries

As of 2012, the military pension beneficiaries are integrated in the existing pension and disability insurance system. The system of mandatory pension insurance in Serbia is based on the pay-as-you-go (PAYG) principle. This means that all employed, self-employed persons and farmers are obliged to pay contributions to the Republic Fund for Pension and Disability Insurance

Koleginica je tražila ime institucije koja se bavi socijalnim osiguranjem. Iako ono podrazumeva penzijsko i invalidsko, zdravstveno i osiguranje za slučaj nezaposlenosti, zaposleni se prijavljuju za socijalno osiguranje u PIO fond

A.  Relevant background information
The applicant was an officer in the National Army (“JNA”) of the former Socialist Federal Republic of Yugoslavia (“SFRJ”). In 1973 he retired according to the Yugoslav federal regulations, and was granted a pension by the Yugoslav Fund for Social Insurance of the Military Beneficiaries based in Belgrade (Zavod za socijalno osiguranje vojnih osiguranika SFRJ; “the Military Fund”).
