Czech term

účinná lítost

Stuart Hoskins Jan 31, 2014:
"genuine remorse" is after the event. "Active repentance" is when you (try to stop) stop the crime from being completed. See http://zakony.centrum.cz/trestni-zakonik/cast-2-hlava-10-dil... and http://www.admin.ch/opc/en/classified-compilation/19370083/i... (Article 23)
Michaela Bordessoule Jan 31, 2014:
"Genuine remorse" is what I hear in English courts a lot.

I appreciate your reply. Thank you very much.
Stuart Hoskins Aug 15, 2013:
active repentance is used in various jurisdictions. Random examples include Switzerland: “Withdrawal and active repentance” http://www.admin.ch/ch/e/rs/311_0/a23.html ;
Hungary: “an agreement based on the suspect’s active repentance should be reached” http://eur-lex.europa.eu/LexUriServ/LexUriServ.do?uri=CELEX:... ; Russia: “exemption from criminal responsibility (Division IV of the General Part), takes active repentance (§ 76) and reconciliation with the victim, into account”

Criminal liability can also expire due to the application of so-called effective remorse. Effective remorse is given when the offender voluntarily prevents or rectifies the detrimental consequences of a criminal offence, or reports a criminal offence to the public prosecutor or the police at a time when the detrimental

In a legal context, the perceived remorse of an offender is assessed by Western justice systems during trials, sentencing, parole hearings, and in restorative justice. However, it has been pointed out that epistemological problems arise in assessing an offender's level of remorse.[1]

As noted above, the Czech authorities indicated that consideration is being given to reinstating
the defence of effective regret for the active bribery offence applicable to natural persons. This could also impact enforcement of the bribery offence against legal persons
