My problem is only regarding the word CHARGE in this specific meaning

: Je ne sais pas trop si on peut utiliser particulièrement dans ce cas le terme "privilège" qui est aussi différent de l' hypothèque dans les démarches

Dans la relation conflictuelle, cette inscription fait obstacle à la vente et il lui est ordonné de la retirer, puisqu'il souhaite recevoir sa part et non racheter la partie du bien qui ne lui appartient pas.
Tant que cette inscription existe, il est impossible de vendre.
Parce qu'il y a un privilège sur le bien.

Dans le cas présent, cela n'a aucun rapport avec une créance, mais d'un droit réservé ipso facto par l'inscription.
je voulais mettre un autre ticket en enlevant le texte explicatif mais on ne m'y a pas autorisé donc je vous explique le vrai contexte /il s'agit d'un tribunal familial anglais qui ordonne à un conjoint de retirer la charge qu'il a enregistré sur le bien qu'il pensait que son épouse allait vendre /
je cherche seulement s'il y a un mot français plus spécifique qui pourrait remplacer le mot "charge" ; comme le droit anglais diffère du droit français en la matière, et comme le conjoint ne veut pas nécessairement acheter le bien en priorité mais recevoir sa part si l'autre vend (somme d'argent), je suis un peu hésitante à parler de droit de préemption
