I am translating a business cooperation contract and have come across these two phrases which I am not sure how to translate.
It is in the section on obligations of one of the parties and the whole clause says:
d. A mantendrá indemne a B frente a cualquier reclamación formulada por terceros en relación con el Software y en particular, en la medida en que dicha reclamación se fundamente en la pretensión de que el Software (o cualquier elemento que integre el mismo) infringe derechos de propiedad intelectual o industrial de terceros, o constituye una apropiación indebida de secretos comerciales o industriales de terceros.
A *** será responsable frente a B y responderá frente a ésta *** por el incumplimiento de las obligaciones asumidas en virtud de este Acuerdo y, en específico, de las reguladas en la presente Cláusula. Por consiguiente, A mantendrá plenamente indemne a B tanto en el supuesto de incumplimiento por parte de A de cualesquiera de las obligaciones aquí previstas así como en caso de inobservancia de las obligaciones que le son atribuibles conforme a la legislación aplicable.
Is there some subtle legal difference between the two phrases?

I think this is bad writing, and you're perfectly justified in tidying it up. You could always add a note to the customer explaining why.

It's a liability clause.

: This is right, no doubt, but you can leave out "answerable to" since the meaning is the same. In the legal speak, "liable" means "answerable according to law". The Spanish is redundant too.

: I don't think you should translate redundancy with redundancy, and your use of "the latter" is a roundabout way of saying "liable and answerable".
