PROCEDURE IN CASE OF DEFECTIVE WORKS-MATERIALS
1. If any work, materials or goods are not in accordance with this Agreement, XXX, without prejudice to its right of compensation, may:
(a) Issue instructions in regard to the removal from the site of all or any of such work, materials or goods and/or,
(b) Issue such instructions requiring a Change (Variation) ***as are reasonably necessary*** as a consequence of such instruction and/or
(c) Issue such instructions requiring the Contractor to open up for inspection or to test ***as are reasonable*** in all the circumstances to establish to the reasonable satisfaction of XXX the likelihood or extent of any further similar non-compliance.
