Mi fiderei anche perché probabilmente l'espressione inglese è stata coniata da un giurista italiano che l'ha tradotta dall'italiano, il che si nota dal fatto che "guarantees" è stato scritto al plurale nonostante come pre-modificatore vada al singolare.
