واحتياطياً من ناحية أخرى، فإن البين من مطالعة صحيفة افتتاح هذه الدعوى أن المدعيين أسندوا مزاعمهم من الناحية القانونية الى نصوص قانون تنظيم مهنة مدققي الحسابات والى أحكام المسئولية التقصيرية في قانون المعاملات المدنية المادة 282 وما بعدها"، والثابت أيضاً أنه لا توجد أي علاقة عقدية من أي نوع كانت تربط المدعى عليها الأولى بأي من المدعيين على الإطلاق، مما يعني أن المسئولية المزعومة في هذه الدعوى مصدرها القانون وليس العقد، أي أنها مسئولية تقصيرية مزعومة، والمقرر في نص المادة 1/298 من قانون المعاملات المدنية أنه (1) - لا تسمع دعوى الضمان الناشئة عن الفعل الضار بعد انقضاء ثلاث سنوات من اليوم الذي علم فيه المضرور بحدوث الضرر وبالمسؤول
