The company BBB below did some fairly ordinary building work for the AAA spouses. The AAA spouses then complained about defects and it all ended up in court. And then in appeal.

L'article 1353 du même code, dans sa version antérieure au 1er octobre 2016, dispose que les présomptions qui ne sont point établies par la loi, sont abandonnées aux lumières et à la prudence du magistrat, qui ne doit admettre que des présomptions graves, précises et concordantes, et dans les cas seulement où la loi admet les preuves testimoniales, à moins que l'acte ne soit attaqué pour cause de fraude ou de dol.
En l'espèce, les parties ne contestent pas le décompte établi par les premiers juges, selon lequel M. et Mme AAA doivent à la société BBB, au titre du contrat de marché et des travaux modificatifs et supplémentaires acceptés pendant le cours des travaux, la somme de 000 000,00 euros, sous déduction des versements qui ont été établis à hauteur de 000 000,00 euros."

Something like "contrat de marché (public)" might be less unexpected in a non-private context. But I don't know what to make of it here. Does it just mean "construction contract", therefore possibly a mis-typing?

In assuming this expression does not appear elsewhere in your text, it seems to me that the follow-on, des travaux modificatifs et supplémentaires acceptés pendant le cours des travaux, is what elucidates things: you have the contrat de marché, the initial contract, and these extra works bolted onto that contract, even if not in so many words (do you have details of the contractual arrangements for thse extra work?).

Marché implies something freely consented. The add-ons are rather less freely consented because they may have involved unsuspected complications that made them more or less obligatory.

Whatever you end up putting, I doubt it will have any real repercussions on understanding.
