I should start by saying that I am not in any way a legal expert — though I do come into contact with a lot of legal documents. I think turning the expression round, to mention 'refund' etc; when there is no such mention in the s/t is "dangerous" because in legal texts at least, a reversed expression may not in fact be exactly the opposite, so it is unwise to play around with the meaning in this way.
While we're at it, is everyone really sure that 'dépens engagés' means the actual legal costs of this divorce? I would have thought that would have been 'frais de justice' etc., and of course we often hear in EN "ordered to pay ... compensation plus costs" Here, the way it is worded suggest to me more about expenditure within the marriage — you know, one spouse agrees to pay for the new kitchen or whatever, or a joint mortgage. |
