In the past, different kinds of lending were often carried out by different types of institutions, which, when it came to lobbying, found it difficult to speak with one voice. Following the major consolidation that took place in the banking sector, though, a smaller number of entities performed all of these lending functions—and for them, a consensus was easier. As a legislative assistant to a member of the Senate Judiciary Committee commented, “The bankruptcy bill is a poster child for what should not happen in Congress. Maybe when there are two opposing powerful [interest groups], ***you get a wash****, but in the bankruptcy bill, there is a real imbalance.” The result was a law that shifted the above-mentioned “balance of power” entirely in favor of creditors.
