disagree  Carl Stoll: The key phrase here is "THEORY of financial intermediation." But we're not talking theory here, we're talking bankruptcy. I'm an economist and I am fairly sure of this. Where am I getting "theory" from? "Current financial intermediation THEORY builds on

-> don't know how you can read it that way! Where are you getting "theory" from? You're not reading original but just an example I posted of "intermediation"

disagree  Carl Stoll: Spanglish: "intervention" is a knee-jerk translation of "Intervención", which in a banking context is called "receivership" in English. Consequently the "internediation" term is equally suspect.

and brokering will be discontinued

Explanation:
"Intermediación financiera" suele traducirse con "brokering" y un "intermediario financiero" es un "broker".

The EN term "financial intermediation" is used in economic theory, but not in economic practise. That means if you go to Wall Street looking for signs saying "financial intermediary", you won't find any, but there are plenty of brokers. The courts do not use economic theory jargon, they use economic practise jargon, at least in the part of the judgment that sayd who must do what. Consequently it is inappropriate to use terms of econ theory when translating bankruptcy judgments.
