On October 18, 2011, the CFTC adopted final regulations on position limits and aggregation of ownership for futures and swaps contracts. These regulations were invalidated on September 28, 2012 by the U.S. District Court for the District of Columbia in connection with a lawsuit filed by the International Swaps and Derivatives Association Inc. and the Securities Industry and Financial Markets Association. It was argued that the Dodd-Frank Wall Street Reform and Consumer Protection Act did not mandate the CFTC to adopt such new position limit rules while foregoing the necessary analysis to demonstrate that such rulemaking is necessary and appropriate to prevent an undue burden on the economy. On November 5, 2013, the CFTC re-issued proposed rules on position limits as well as aggregation of ownership under Part 150. The proposed rules provide position limits and limit formulas for 28 exempt (e.g. metal and energy contracts) and agricultural commodity futures and option contracts and physical commodity swaps that are economically equivalent to such contracts, narrow the definition of a bona fide hedging transaction for position limit exemption purposes, and expand position aggregation standards.
