will additionally be subject to loss of parental or guardianship rights (in this context) Explanation: In the Spanish Criminal Code “inhabilitación especial” refers to various sentences that can be imposed to terminate certain specific types of rights defined in that code. I assume that the rights terminated by “inhabilitación especial” will also be defined somewhere in the code from which the text you are translating was taken. In your text, “inhabilitación especial” appears specifically to denote the loss of parental or guardianship rights over the persons being exploited in begging (which includes not only children and adolescents, but also the disabled and the elderly). You might translate this otherwise, but a possibility would be: Si el autor de este delito fuera el responsable legal, se impondrá además la inhabilitación especial de uno a cuatro años para ejercer los derechos derivados de la relación madre, padre e hijos, tutela o guarda. = If the perpetrator of the offense is the parent or legal guardian, he will additionally be subject to loss of parental or guardianship rights for a term of one to four years. I don’t think “disbarment” would be appropriate in this context, since the term generally denotes the termination of a lawyer’s right to practice law. Moreover, I don’t believe disbarment is usually addressed in criminal codes, but rather it is bar associations (“colegios de abogados”) that, under certain circumstances, reserve the power to disbar their members. |

This is really rough, but I don't think you need to add "will also be ordered". **If the perpetrator of this crime is the legally responsible guardian of the child, (particular/specific) disqualification (period of barring) will also be imposed from one to four years in the exercising of the rights derived from the relationship between mother, father and children, guardianship or custody.** P.S. It is not "disbarment" https://dictionary.cambridge.org/dictionary/english/disbarme... the act of taking away someone's right to work as a lawyer, especially because they have done something wrong or illegal, or the situation of having this right taken away from you. Aaaayyy! Just seen Rebecca's suggestion, but I will post for what it is worth. -------------------------------------------------- Note added at 1 hr (2020-09-26 18:43:14 GMT) -------------------------------------------------- Some additional resources: https://www.legislationline.org/download/id/6443/file/Spain_... (I've gone back to the Spanish CC again). Article 39 (From Spanish CC) (page 17) speaks to penalties on the deprivation of rights. See Article 46 which reads: Special barring from exercise of parental rights, guardianship, care, safekeeping or fostership, deprives the convict the rights inherent to the former, and brings about extinction of the others, .... The punishment of deprivation of parental rights implies the loss of entitlement thereof ... Articles 55 and 56 also speak to barring/deprivation of parental rights. |
