"The proviso at the end of s. 14, sub-s. 1, of the Sale of Goods Act, 1898, applies, and consequently there was no implied condition as to the fitness of these specified articles for the particular purpose for which they were wanted.

The articles did in fact answer the description of them in the contract and ***none the less so*** because the defects were patent, latent, or discoverable: Randall v. Newson. The particular articles ordered by the contract having delivered, there was no implied warranty that they should be fit for the purposes of the plaintiff's traffic."
