Las medidas cautelares son, como su nombre lo dice, las medidas que toma una autoridad dentro de un procedimiento penal para asegurar bienes o pruebas, mantener ciertas situaciones sin alterar, para evitar posibles daños al interés general o también para evitar posibles daños al interés general o al patrimonio del Estado, para proteger personas, para garantizar la reparación del daño o para evitar que los acusados se den a la fuga, aunque de acuerdo a la ley estas se dictan para: asegurar la presencia del acusado en el juicio, mantener seguras a las víctimas, ofendidos y testigos, y evitar la obstaculización del juicio (artículo 153 del Código Penal Federal). Estas se ordenan una vez iniciado el juicio contra el acusado (artículo 154 del Código Penal Federal).
¿Cuáles son las medidas cautelares?

El artículo 155 del Código Nacional del Procedimientos Penales establece 14 medidas cautelares distintas, estas son:

La presentación ante el juez cada cierto tiempo o ante otra autoridad que este designe.
El pago de una garantía económica.
Un embargo.
El congelamiento de cuentas bancarias y otros valores que formen parte del sistema financiero (acciones/bonos).
Que se prohíba al acusado abandonar cierta área geográfica.
La orden de someterse al cuidado de una persona o institución determinada.
La prohibición de ir a ciertos lugares.
La prohibición de tener contacto con ciertas personas incluyendo a víctimas, ofendidos y testigos.
Ser retirado de su domicilio.
Suspensión de su empleo si fuere un servidor público.
Suspensión de su profesión u oficio.
La colocación de localizadores electrónicos.
El tener que permanecer en su domicilio.
La prisión preventiva.

Consecuencias de desobedecer las medidas cautelares

Si existiera incumplimiento de alguna de las medidas que no sean la prisión preventiva y el pago de la garantía, la primera consecuencia será la revisión por parte de la autoridad judicial de las medidas cautelares impuestas.

Ahora que si se trata de las que consisten en la prohibición de salir de una área geográfica determinada, o de la prohibición de acercarse a personas, o lugares, la separación del domicilio, la colocación de un dispositivo electrónico o el resguardo domiciliario, la consecuencia inmediata será el arresto del acusado.
Las medidas cautelares fuera del Derecho Penal

Esta figura no es exclusiva del Derecho Penal, pues como puede verse existe en diversos ordenamiento como en la materia Civil donde se les denomina medidas precautorias y son reguladas por el artículo 610 del Código de Procedimientos Civiles Federal, o en la materia de responsabilidad administrativa por ejemplo en la Ley General de Responsabilidades Administrativas que las regula en su Título Segundo, Capítulo I, Sección Tercera.
