In re K (A Child) (Reunite International Child Abduction Centre intervening) [2014] AC 1401, Lady Hale posed the following question when considering whether “rights of custody” should be interpreted as including, what have been called, “inchoate rights”:
“[3] The issue … is between two different approaches to the interpretation of the concept. Is it to be interpreted strictly and literally as a reference to rights which are already legally recognised and enforceable? Or is it to be interpreted purposively as a reference to a wider category of what have been termed “inchoate rights”, the existence of which would have been legally recognised had the question arisen before the removal or retention in question? The issue is well illustrated by the facts of the present case.”

Asker: Je suis rassurée de ne pas avoir trouvé de traduction "directe", je vois que ce n'est pas très simple. Le terme de "droit en cours d'acquisition" me semble refléter le mieux de concept de inchoate. Merci.

inchoate crimes: attempt, conspiracy are more common / commoner than 'inchoate rights', but this is a case where Lexique anglais-français du Conseil de l'Europe (principalement juridique) agrees with the asker's own suggestion of "droit en cours d'acquisition".

Alas, IATE's droit virtuel or imparfait - as reflections of the translations in Lexique anglais-français de la Common law, Moncton University, Canada - is an odd way of describing the ambiguous epithet of 'rights' of (child vs. police) custody.

Compare - by close analogy - a sale of property off-plan: une vente en l'état futur d'achèvement.

Asker: Oui, j'ai trouvé aussi ce terme en français, mais cette traduction ne me plait cependant pas vraiment car inchoatif est une francisation de l'anglais, il ne correspond pas à un terme juridique français. En français le terme inchoactif vient de la linguistique et non du droit.
